Privacy notice for prize competitions

INTRODUCTION

The purpose of this document is to inform you about the processing of your personal data in connection with prize competitions of Messer SE & Co. KGaA.

PERSONAL DATA

The term “personal data” means all information that can refer to you as a natural person. This includes information that can only be indirectly attributed to you, for example by assigning it to an identifier such as a name, identification number, location information or online identifier. A person is also considered identifiable if they can be identified using one or more special characteristics that are an expression of the physical, physiological, genetic, mental, financial, cultural or social identity of this natural person.

  3. What data does Messer SE & Co. KGaA process?
    Within the context of the prize competition, Messer SE & Co. KGaA will process your contact details such as your first name and surname, the address provided by you (including the country), e-mail address and telephone numbers.

  4. What does Messer SE & Co. KGaA do with the data?
    Messer SE & Co. KGaA processes your personal data solely for the purpose of carrying out the prize competition, for subsequently notifying the winner and for publishing the first name and surname and domicile (including the country) of the winner in the following issue of Gases for Life.

      Upon request you have the right to obtain information about the personal data stored concerning you (Art. 15 GDPR).

      In addition, you have the right to request rectification of inaccurate personal data (Art. 16 GDPR), the right to request a restriction of processing of data that is being processed too widely (Art. 18 GDPR), as well as the right to demand erasure of personal data that is being processed unlawfully or of data that is stored for too long (provided that there are no statutory reasons requiring the data to be retained and there are no other reasons pursuant to Art. 17(3) GDPR) (Art. 17 GDPR). Furthermore, you have the right to obtain the personal data provided by you to Messer SE & Co. KGaA (Art. 20 GDPR) if you have provided the data to us within the context of a declaration of consent or to perform a contract. You (or a third party specified by you) will receive the data in a structured, commonly used and machine-readable format (right to data portability). We also draw your attention to your right to object (Art. 21 GDPR).

      In addition, you have the right to complain to a data protection supervisory authority about the processing of your personal data by us (Art. 77 GDPR).
    2. General information about the legal basis for the data processing
      The processing of personal data by Messer SE & Co. KGaA is based on Art. 6(1)(b) GDPR. According to this, processing is lawful if it is necessary for the performance of a contract to which the data subject is party, or in order to take pre-contractual steps at the request of the data subject. Messer SE & Co. KGaA processes personal data for the purpose of performing the prize competition contract.
    3. General information about Messer Information Services as a recipient of data
      The IT programs used to process your data are hosted by Messer Information Service GmbH. In this context, Messer Information Service GmbH only carries out data processing tasks on our behalf and in accordance with the instructions given by Messer SE & Co. KGaA.
    4. Recipients or categories of recipients of data

      Messer SE & Co. KGaA will only disclose data to third parties if there is a legal basis for doing so, for example where consent to disclose to third parties has been provided, if the performance of a contract so requires, if justified by legitimate interests – in particular within the companies of the Messer Group – or to fulfil legal requirements that oblige us to provide information, notification or to disclose data.

      Otherwise, data will only be disclosed to external service providers that process the data exclusively on our behalf. Such a service provider is Agentur Brinkmann GmbH, Mevissenstrasse 64a, 47803 Krefeld, Germany, which processes the data on our behalf as a contract processor.

      Within Messer SE & Co. KGaA, only the internal offices and departments receive the personal data that are necessary for and required to fulfil the task.
    5. General information about the retention period 
      Personal data is retained in accordance with the applicable national retention rules (in particular tax taw and commercial law) for a period of up to 10 years. 
    6. Processing of your data in a third country
      A transfer of data to organisations in states outside the European Union (EU) or the European Economic Area (EEA) (known as third countries) will take place if a legal basis (such as consent) exists, the performance of a contract so requires or if prescribed by law. 

      In this regard, processing of your data in a third country can also take place in connection with involving service providers within the context of contract processing.

      In the absence of an adequacy decision by the EU Commission regarding an adequate level of data protection for the country concerned, pursuant to EU data protection requirements we will use appropriate contracts to ensure that your rights and freedoms are adequately protected and safeguarded. Relevant information, supporting documents and copies can be requested from Messer SE & Co. KGaA. 

    7. Information pursuant to Art. 13(2)(e) GDPR 

      The provision of personal data is required to enter into the contract relating to the participation in the prize competition. You are not obliged to provide your personal data. There is no consequence of you not providing your personal data; however, in such a situation it is not possible to take part in the prize competition.
